Structure and Composition of the Supreme Court

The Supreme Court is composed of seven judges, including the Chief Justice, who serves as the President of the Court, and the Deputy Chief Justice, who serves as the Vice President. The other five judges, appointed through a selection process governed by the Judicial Service Commission (JSC), are drawn from Kenya’s pool of legal experts, all of whom are experts in constitutional law, governance, and judicial matters.

Judges of the Supreme Court, including the Chief Justice, serve until the mandatory retirement age of 70, with the provision that the Chief Justice cannot serve for more than 10 years. This ensures that the leadership of the Court remains dynamic and representative of the country’s evolving legal needs.

The Court is properly constituted when five judges sit to hear a case, while interlocutory matters can be handled by two judges. This ensures the Court’s ability to function efficiently and effectively while maintaining its capacity to deliver comprehensive judgments.

The Supreme Court plays a vital role in upholding the integrity of the Kenyan electoral process. In that case, the Court ruled to nullify the election of President Uhuru Kenyatta due to widespread irregularities and illegalities in the conduct of the election. This ruling marked the first time in Kenya’s history that a presidential election result was overturned by the Court, reinforcing its role as a guardian of the Constitution.

  • 2013 Presidential Election Petition: In this case, Raila Odinga contested the results of the presidential election, alleging electoral fraud. The Supreme Court, after a thorough review, upheld the election of Uhuru Kenyatta, affirming the validity of the electoral process.
  • 2017 Presidential Election Petition: In one of its most high-profile rulings, the Court nullified the 2017 election results, citing significant irregularities in the transmission of votes and violation of the Constitution. This ruling led to a fresh election, which was subsequently held within 60 days.
  • Advisory Opinions: The Supreme Court has also played a crucial role in providing advisory opinions on issues like the constitutionality of amendments and the validity of declarations of a state of emergency, ensuring that all actions taken by the government are in accordance with the Constitution.

Current Leadership and Judges

The current Chief Justice of Kenya is Martha Koome, who assumed office on May 21, 2021. Under her leadership, the Supreme Court continues to advance the rule of law and protect the Constitution. The other current judges of the Supreme Court include:

  • Hon. Lady Justice Philomena Mwilu – Deputy Chief Justice
  • Hon. Justice Dr. Smokin Wanjala
  • Hon. Lady Justice Njoki Susanna Ndung’u
